Response dated 17 January 2025 (ref FOI2471) to Fraser Knight's batch 'LBC REQUEST - FOI SEND provision' request. Legal costs: 'Between 1 January 2019 and 1 October 2024, 207 appeals were issued. Approximately 325,000 GBP was spent on solicitors' costs, and 47,432 GBP on external counsel. Non-solicitor legal staff time is not recorded.' Appeals/outcomes: '207 appeals have been lodged with the SEND tribunal between 1/01/2019 and 30/09/2024. Of the 207, 170 appeals have been complete so far. Of these, 5 resulted in the appeal not being allowed. However, two were struck-out and a number were withdrawn and did not reach final hearing.'
Caveat: No year-by-year breakdown given — all figures are cumulative totals across the 1 Jan 2019-1 Oct 2024 window. The number of withdrawn appeals is not quantified ('a number were withdrawn'), only described qualitatively — of the 170 completed appeals, only 5 (not allowed) + 2 (struck out) = 7 are precisely accounted for; the remainder (163) are attributed to an unspecified number withdrawn plus, implicitly, appeals decided in the appellant's favour, but the letter gives no figure for appeals actually decided against the council.
