Structured outcome breakdown

Structured breakdown — 2019
real, from FOI response
82.1%
15.4%
Resolved before hearing — 32 (82.1%) Contested, council lost — 6 (15.4%) Contested, council won — 1 (2.6%)
Council gave distinct 'filed'/'conceded prior to appeal date'/'won by WCC'/'lost by WCC' figures directly (no aggregation needed). Figures do not sum exactly to the filed total (32+1+6=39 vs 41 filed) -- a gap of 2, unexplained by the council in this response. This is a newly spotted inconsistency for this council (distinct from the Rutland/Sheffield/Wigan/Bristol/Barnsley cases already known to the project).

Freedom of Information responses

Requested by SEND Crisis Warwickshire (signed 'SEND National Crisis Warwickshire') on 2021-04-03 · answered 2021-05-04 · covers 2019, 2020, 2021
Response dated 4 May 2021 (ref 6667772) to a request titled 'SEND National Crisis Warwickshire', a numbered Q1-24 questionnaire covering both mediation and tribunal activity. Tribunal-specific answers (Q10-24): 'Number of SEND tribunal appeals filed against WCC': 2019: 41; 2020: 15; 2021: 15. 'Number of SEND tribunals conceded by WCC prior to appeal date': 2019: 32; 2020: 11; 2021: 0. 'Number of SEND tribunals won by WCC': 2019: 1; 2020: 0; 2021: 0. 'Number of SEND tribunals lost by WCC': 2019: 6; 2020: 3; 2021: 0. 'Amount spent by WCC on all SEND tribunal appeals (conceded, won or lost)' — council held this by financial year, not calendar year as asked: figure given against the '2019' question = 2018/19: 54,936 GBP; against '2020' = 2019/20: 88,966 GBP; against '2021' = 2020/21: 133,855 GBP.
Caveat: The response is dated 4 May 2021, so the '2021' figures cover only roughly the first four months of that calendar year — this explains why 2021 shows 0 conceded/won/lost against 15 filed (SEND tribunal cases typically take many months to reach an outcome, so most or all of the 15 filed in early 2021 would still have been unresolved at the time of the letter). Cost figures were supplied by financial year (April-March) rather than the calendar year actually asked for, which the council flagged itself: 'Please note: Warwickshire County Council hold the Finance information required to answer questions [7,8,9 and 22,23,24] by Financial Year, not Calendar Year as requested' — so e.g. the '2019' cost figure of 54,936 GBP is actually FY2018/19, not calendar 2019. Filed/conceded/won/lost figures do not sum exactly to the filed total (e.g. 2019: 32+1+6=39 vs 41 filed; 2020: 11+0+3=14 vs 15 filed) — the small gaps are unexplained in the letter, possibly withdrawals or other pending outcomes.
